1. General

These Terms of Use are an agreement between you and PYRAMIDS ECOMMERCE DOO BEOGRAD (STARI GRAD) (a company registered in Serbia, company registration number 22316567, tax identification number PIB 115796510, address Obilićev venac 18, lokal 3.15, 11102 Beograd (Stari Grad), Serbia; hereinafter “we”, “us” or “the platform operator”) governing the use of “Qvant” (the website and the mobile app; hereinafter “the Platform”). By registering for, logging in to or using the Platform, you confirm that you have read and agree to these Terms of Use, as well as the “Privacy Policy” and the “Disclaimer”.

The Platform is an information platform for used phones (an advertising platform) for individuals and businesses buying and selling used phones in Serbia. It provides features for posting and browsing listings, displaying device condition, in-app chat, saving listings and alerts, reviews, reporting and more.

We provide only tools for displaying information and communicating within the Platform. We do not take part in transactions between users, do not provide payment, logistics or courier services, and are not the buyer, seller or guarantor in any transaction between users.

Exception: listings marked “Official” are posted by us (the Qvant official store) and offer phones that we own. For these phones we are the seller and bear the seller's liability under Serbian law; the specifics are governed by the description in the official store's listing and by what the parties agree at the time of the transaction. Phones sold by the Official Store come with a 1-year Qvant warranty covering product quality defects. The warranty does not cover damage caused by the user; damage, failure to turn on, or functional problems caused by unlocking, flashing, or rooting the phone yourself; or phones repaired or with parts replaced at a third-party phone shop, repair shop, or through any other channel. This warranty does not affect the mandatory rights granted to consumers by law.

2. Account

You can register with a phone number from any country or region (select the country or region when registering, or enter the full number including the country code). When registering, you set your own login password (8–64 characters, containing both letters and digits), and you then log in with your phone number and password. Each phone number can be linked to only one account, and your phone number is your login ID. You can change the linked phone number under “Me → Change Phone Number” (your login password is required, and the number can be changed at most once every 30 days); after the change, you will be logged out on all other devices. The replaced phone number cannot be registered or linked by any other account for 30 days, and you can switch back to it within those 30 days. If you can no longer use your original phone number and cannot log in to your account, you can contact Support, and we will help you change the number after verifying your identity.

You must register with a phone number that you lawfully hold, keep your password safe, never tell your password to anyone (our staff will never ask you for your password), and not use the same password as on other websites. Any actions performed through your account are deemed to be your own actions. If a wrong password is entered too many times in a row for the same phone number, it will be temporarily locked. You stay logged in for up to 30 days; after you change your password, you will be logged out on all other devices. If you discover that someone else is using your account, change your password immediately and contact us.

If you forget your password, please contact Support: once Support has verified that you are the holder of the phone number (for example, by asking you to call or send a text message from that number), your password will be reset to a temporary password, and after logging in with it you must immediately set a new password; when the password is reset, you will be logged out on all devices. Accounts are tied to phone numbers: when a person who can prove that they hold a phone number contacts Support, we may reset the password of that account for them. Therefore, please do not register with someone else's phone number.

Publicly displayed content such as nicknames, profile photos, bios and shop names must not be unlawful, infringing or misleading, and must not impersonate the Platform or anyone else (for example, nicknames must not contain words such as “Qvant”, “Official”, “Support”, “Admin” or “Platform”, and shop names must not contain “Official”, “Platform” or “Qvant Support”).

Nicknames and shop names across the Platform must not be identical or too similar to anyone else's (names that differ only in upper or lower case, full-width or half-width characters, spaces or punctuation, traditional or simplified Chinese characters, or similar-looking letters or digits (e.g. I, l, 1; 0, O) are all considered similar; your own nickname and shop name may be the same). Your nickname and your shop name can each be changed only once every 30 days (the first nickname change after registration and the first time you set a shop name are not limited; the limit is tracked by phone number, so deleting your account and re-registering with the same phone number does not reset it). After an account is deleted, its former names may be used by others; if an account is banned, its names remain reserved. If a name violates the rules, we may reset the nickname to the system default nickname and clear the shop name; you can then change them again, but you may not reuse the reset name or any name too similar to it.

The Platform is intended only for adults aged 18 or over. By registering an account, you confirm that you are at least 18 years old; if you are under 18, please do not register an account. If we discover that the user of an account is under 18, we may ban the account.

3. Individual and Business Status

Each account can choose either “Personal” or “Business” status; the choice takes effect immediately upon saving and can be switched. Once you choose Business status, shop details such as the shop name and logo are displayed publicly right away; the “Verified Business” badge is displayed only after we have reviewed and approved it (see the next clause).

If you choose Business status, you must truthfully enter your shop name and company information (company name and tax identification number PIB), and you may optionally add a shop description, a public contact phone number and your region; you are responsible for this information being true and lawful. Your business activities must comply with Serbian regulations on business operations, taxation and other matters. The company name and tax identification number are visible only to you and the platform administrators and are not displayed publicly.

Business verification: after submitting your business details, you need to contact our Support (the in-app “Qvant Support” chat or the Support phone line) and provide, as instructed, the materials required to verify your company information (for example, your business registration certificate); we then review it manually. Verification is free of charge. Once approved, the “Verified Business” badge is shown on your profile, your listings and in chats; while the review is pending or if it is not approved, your shop name and logo are still displayed under Business status, but without the badge. If it is not approved, the “Identity” page will state the reason (if any), and you can make changes and resubmit. If you change the company name or tax identification number after verification, a new review is required; if you switch back to Personal status while an application is still under review, the application is deemed withdrawn. If we discover that the submitted information is false or that the business has violated the rules, we may revoke the verification.

The “Verified Business” badge only means that, during our review, we checked the company name and tax identification number submitted by that business. It does not constitute any guarantee by us of the business's licenses, creditworthiness or the quality of its goods and services, nor does it mean that we vouch for the business.

The public contact phone number provided by a business is shown only to logged-in users. If a business violates these Terms, we may revoke its Business status and lock it; the lock follows the phone number, so no account using that phone number (including accounts re-registered after deletion) can choose Business status again, and if a locked account changes its phone number, the new phone number is locked as well (see “Reports and Handling of Violations” below).

4. Posting Listings

Listings go live immediately after posting, without prior review. Each listing requires 1–9 photos. Listings expire after 30 days and are then no longer publicly displayed; within the 3 days before expiry or after expiry, a listing can be renewed for 30 days with one tap. Each account can post at most 20 listings within 24 hours.

You must ensure that the information you post is true, accurate and matches the actual item, that you are entitled to sell the phone you list, and that the price is clearly stated (fixed price or negotiable). When a phone has been sold or is no longer for sale, please promptly mark it as sold or take the listing down.

When listing a phone, you must truthfully state its condition (brand, model, storage capacity, cosmetic condition, dents and scratches on the frame and screen, face unlock / fingerprint, repair history, battery health, whether iCloud / Find My has been signed out, etc.). Uploaded system screenshots (battery health, iCloud, parts and service history) must be genuine screenshots of that very phone; they must not be altered, and screenshots of other phones must not be used. The “Screenshot proof” and “Seller-reported” labels on listings only indicate the source of the information; we do not inspect phones sold by third-party sellers. “Inspected by Qvant” is used only for phones that the Qvant official store has inspected and sells itself.

Uploaded photos are reprocessed, and additional information such as the shooting location is removed. You warrant that you hold the necessary rights to the photos and text you upload, and you grant us a free license to display, store and compress them and generate thumbnails of them on the Platform (including in share links and search results) for the purpose of providing the service.

The following content may not be posted:

  • goods, services or information that violate the laws and regulations of Serbia;
  • weapons, ammunition, explosives and their accessories, and restricted knives;
  • narcotics, prescription drugs and other controlled medicines, and goods that require a license to sell where you do not hold such a license (e.g. tobacco, alcohol);
  • counterfeit or substandard goods, stolen goods, or goods of unknown origin;
  • content related to pornography, gambling, pyramid schemes, fraud or money laundering;
  • the buying, selling or renting of identity documents, bank cards, SIM cards or accounts of any kind, and other people's personal information;
  • protected wild animals and plants and products made from them;
  • content that infringes other people's intellectual property rights, image rights, reputation or privacy;
  • content unrelated to phones, duplicate listings, or content that uses listings as a pretext for advertising or diverting traffic;
  • stolen or lost phones; locked phones (not signed out of iCloud / Find My, or carrier-locked) where the lock is not truthfully disclosed; refurbished, assembled or replica phones passed off as original; phones with an altered IMEI;
  • information on private currency exchange or exchanging foreign currency on behalf of others (including buying, selling or exchanging euros, dinars, renminbi or other currencies on behalf of others, privately collecting or making payments on behalf of others, and sending money transfers on behalf of others);
  • labor-agency information on recruiting or referring persons from outside Serbia to work in Serbia, arranging work visas or residence permits on their behalf, or charging agency fees or other fees;
  • other content that is contrary to public order and morality or that we consider unsuitable for posting.

Qvant has zero tolerance for objectionable content and abusive behavior, such as illegal, pornographic, violent, harassing or fraudulent content: once we discover it or receive a report, we will act within 24 hours, remove the violating content and, depending on the circumstances, ban the poster's account. Users can report objectionable content and block users who harass them at any time.

If you sell phones under Business status, you must also comply with Serbian regulations on business operations, taxation and consumer protection.

5. In-App Chat and Blocking

From any publicly visible listing, you can start a chat with the poster and send text and images. Your chats with other users can be seen only by the two participants in the chat; we view the relevant content only when handling reports or disputes or when required by law (see the “Privacy Policy”).

Platform Support: through “Me → Contact Support” or business verification, you can chat in-app with our official support, “Qvant Support” (text and images; when you start the chat from business verification, your shop name and verification status are attached automatically). Support is staffed by the platform administrators, and any administrator may reply to you; Support will never ask you for your password. Reviews, blocking and reporting do not apply to chats with Support.

You must not use chat to send harassing, abusive, advertising, fraudulent or other unlawful content. Each message may contain at most 1,000 characters, and each person may send at most 30 messages per minute.

You can block the other party: once blocked, neither of you can send messages to the other or start a new chat; reviews are not affected.

For your safety, please communicate within the Platform whenever possible, and do not give the other party verification codes, bank card details, identity document details or similar information.

6. Transactions Between Users and Safety

We do not take part in transactions between users: we do not record transactions and do not provide payment, guarantee, logistics or courier services. The price, the phone, delivery and after-sales matters are negotiated and handled by the parties themselves and have nothing to do with us. Purchases from the Qvant official store are governed by the exception in “General” above.

We recommend inspecting the phone in person (that it powers on, face unlock / fingerprint, iCloud / Find My signed out, battery health, and whether the serial number matches the packaging) and paying only once everything checks out. Do not transfer money or pay a deposit to strangers in advance, and do not disclose verification codes, bank card details or identity document details.

In the event of a dispute, please first try to resolve it with the other party. If the other party is suspected of violating the rules or of fraud, you can report them; we will deal with the violating account based on the information available to us, but we cannot guarantee that any loss will be recovered. If a crime is suspected, please report it to the police.

7. Reviews

Once both parties have sent at least one message in the same chat, they can review each other: 1–5 stars (required) and up to 300 characters of text (optional). You cannot review yourself.

Only one review per person for the same user is kept; it can be edited (and will then show “Edited”) but cannot be deleted. A review is publicly displayed on the other party's profile immediately after it is submitted. Each person may write or edit reviews at most 20 times within 24 hours.

Positive review rate = number of people who gave a positive review (4 or 5 stars) ÷ number of reviewers. Reviews and positive review rates come from users and are for reference only.

Reviews must be objective and truthful. Manipulating reviews (including reviewing each other with multiple accounts, having others write reviews for you, or offering benefits in exchange for positive reviews) is strictly prohibited: once discovered, all accounts involved will be permanently banned. You must not use reviews to insult others, disclose other people's private information or post advertisements. We may hide reviews that violate the rules; hidden reviews are no longer displayed and are not counted in the positive review rate. Once an account is banned or deleted, the reviews it wrote are likewise no longer displayed and are not counted in the positive review rate.

8. Reports and Handling of Violations

You can report listings or users that violate the rules by selecting a reason and adding details. The same listing or user can be reported only once before the report is handled, and each person can submit at most 10 reports within 24 hours. Please report truthfully; we may take action against anyone who files malicious reports.

We will handle the reports we receive and the violations we discover and, depending on the circumstances, take one or more of the following measures, without prior notice where necessary:

  • Removing a listing for violation: the listing is no longer publicly displayed and the poster can no longer edit it; the listing's photos are moved to non-public quarantine storage and kept as evidence, viewable only by the platform administrators;
  • Hiding reviews that violate the rules;
  • Revoking business verification: the “Verified Business” badge is no longer displayed, the reason is shown on the “Identity” page, and the business can make changes and resubmit for review;
  • Revoking Business status and locking it: the account is switched back to Personal status and its business verification is revoked as well; the lock is recorded against the phone number, so no account using that phone number (including accounts re-registered after deletion) can choose Business status again, and if the phone number is changed, the new phone number is locked as well; the reason is shown on the “Identity” page;
  • Banning the account: the account can no longer log in, post, chat, review or report; all of the account's listings are automatically removed for violation (their photos are likewise moved to quarantine storage), and its profile and the reviews it wrote are no longer publicly displayed; listings are not automatically restored when the ban is lifted;
  • Banning the phone number: when an account is banned for violations, its phone number may be banned at the same time (including the phone number that an already deleted account used before deletion); a banned phone number cannot be used to log in, register a new account or be linked to another account by changing phone numbers, and any account currently using that phone number is banned as well;
  • Resetting a name that violates the rules: resetting the nickname to the system default nickname, or clearing the shop name (after which the account is switched back to Personal status; it can switch to Business again after entering a new shop name);
  • Reporting to the competent authorities in accordance with the law, or cooperating with their investigations.

If, after a listing or account has been reported and before we have finished handling the report, the poster edits the listing (title, description, price, category, region, or deletes or replaces photos), changes their profile photo or shop logo, changes their nickname or shop name, or edits their bio, shop description or shop contact phone number, the content and photos as they were before the change are kept as evidence (not publicly displayed and viewable only by the platform administrators), and are also kept for a period after handling is complete (see the “Privacy Policy”).

We have the right, but not the obligation, to review content posted by users; our handling of certain content does not mean that we endorse other content that has not been handled. If you disagree with the outcome, you can file an appeal using the contact details below.

9. Deleting Your Account

You can delete your account at any time by tapping “Delete Account” at the bottom of the “Me” page. Deletion cannot be undone. After deletion:

  • the account can no longer log in and is shown publicly as “Deleted user”, all its listings are taken down, and all login sessions become invalid;
  • the phone number can be used to register again in the future, and the new account is unrelated to the original account (unless the phone number has been banned by us); business locks and phone number bans follow the phone number and are not lifted by deletion; the former nickname and shop name may be used by others;
  • for the purpose of handling disputes and as required by law, your data and records (including your phone number, nickname, profile photo, bio, shop details and company information, listings and photos, chat history, reviews, reports and block list) are not deleted immediately but are kept for a period, during which they are not publicly displayed (except for the chat history described in the next point) and are viewed only by the platform administrators when handling disputes or as required by law; the retention periods are set out in the “Privacy Policy”;
  • your chats with others remain visible to the other parties, with you shown as “Deleted user”; the reviews you gave are no longer publicly displayed and are not counted in the other parties' positive review rates (they are kept as described in the previous point).

10. Intellectual Property

The Platform's name, logo, page design and software are owned by PYRAMIDS ECOMMERCE DOO BEOGRAD (STARI GRAD). Content posted by users belongs to the users or the original rights holders; the license you grant us is described in “Posting Listings” above. Once content is deleted or the account is deleted, we will stop using it, except where it must be retained under the law or these Terms.

If you believe that content on the Platform is unlawful or infringes your rights, please notify us using the contact details below, specifying the listing or user concerned and enclosing proof of your identity and of your rights. Upon receipt we will promptly verify the matter and, if we confirm that the content is unlawful or infringing, promptly remove or block it; where necessary, we will ask the competent authority to make a determination.

11. Paid Services and Changes to the Service

Registration, posting listings, in-app chat, saving listings, alerts, reviews, reporting, business verification and similar features are free of charge.

Alerts send a push notification when a new listing matching your criteria is posted. They may be delayed or not received due to the network, the push notification service, phone settings or other reasons; we do not guarantee delivery, nor that a phone matching your criteria will become available.

We may suspend some or all of the services due to maintenance, upgrades, malfunctions or force majeure, and will try to give advance notice; we may also adjust features according to operational needs. For limitations of liability, see the “Disclaimer”.

12. Changes to These Terms, Governing Law and Dispute Resolution

We may amend these Terms. Amendments will be published on this page and the “Last updated” date will be updated; material changes will be prominently announced on the Platform. If you continue to use the Platform after an amendment, you are deemed to agree to the amended Terms.

The conclusion, validity, interpretation and performance of these Terms are governed by the laws of the Republic of Serbia. Any dispute arising from these Terms or from the use of the Platform shall first be resolved by the parties through amicable negotiation; if negotiation fails, the dispute shall fall under the jurisdiction of the competent court in Belgrade, Serbia. If you are a consumer, the mandatory rights granted to consumers under Serbian law (including the statutory court of jurisdiction and out-of-court consumer dispute resolution) are not affected by this clause.

These Terms are provided in English, Serbian and Chinese. In the event of any inconsistency between the versions, the English version shall prevail, unless mandatory provisions of law provide otherwise.

If any provision of these Terms is held invalid or unenforceable, this shall not affect the validity of the remaining provisions.
